Rhode Island pushes back on trucking industry lawsuit against tolls

Rhode Island is trying once again to keep a trucking industry lawsuit that could tear down the state’s truck toll system out of federal court. In early December a federal appeals court unanimously reversed a U.S. District Court ruling to dismiss the lawsuit, which argues that truck tolls are unconstitutional, and remanded it back to the lower court. But on Thursday the state petitioned to have the appeal re-argued on the grounds that the judges did not apply “the proper test” to whether the case should be left for state courts to decide, as Rhode Island’s lawyers have argued…
