    I have been told that since the recession, all cities have clamped down on any infraction including speeding. I have been told this means even 3 mph over the speed limit. The cities need the money and truly, they do not give one whit about individual drivers, even if those drivers are facing the notion of living under a bridge. :S

    I agree with Sunshine, I don’t think any judge will be sympathetic. Apparently, you were speeding, and that was your choice, regardless of if the rental agency de-railed your schedule. Not want to sound judgemental at all- I’ve had my share of making mistakes and consequences of them. But maybe next time someone makes you late for a commitment….and it will happen again!….you can consider just calling the destination and explaining why you are running late, but that you are on your way.

    Having said that, here are a few suggestions:

    1. Fight the ticket, even if it is inconvenient. Speak to the DA prior to your court date, and explain what happened. They could possibly put in a good word with the policeman and/or judge. Its possible that there is an error on the paperwork, or that the judge would give you a dismissal based on (if) you have a prior clean record.

    2. Is possible that the speedometer is faulty. I once got a speeding ticket where my equipment was truly faulty…. on the day of my ticket, all three of my gauges had started flat-lining intermittently. I was trying to stay with the flow of traffic, but turns out I was going 8 mph over the limit. I was out of my state, and I realize most cops target out-of-towners, assuming the person will just pay the fine and move on. I knew for a fact my equipment was incorrect, so I had it checked and replaced by a licensed mechanic. Presented it in court (yes, I returned to that state to address the ticket.) It was dismissed.

    3. If BBB refuses to help, I would still write to the owners of the rental place, and explain what a hardship the employee’s failure caused you. If nothing else, someone will have to deal with reading and responding to your letter. You can also put a note on their blog or review site. Don’t be nasty, just state in black & white what happened and how it affected you.

    I think the people at Monitech and DMV are elusive, because they have been trained that a lot of people will never cut back or stop drinking,.. and also try to beat the “program,” so they don’t want to give too much information that may help them to circumvent the system.

    I am okay with that. I just want to survive the program and move on with my life. I don’t care what information they withhold as long as the device works well enough for me to get through this…..

    These devices are very faulty.

    But you still have to play by the rules, to get through the program.

    1- Dont use mouthwash at all

    2- Never eat or drink anything in your car other than water. Keep water bottles in your car.

    3- If you ever get a Warn, stop the car. Don’t drive. The Rolling Fails are worse than the Starting Warns. Swish with water and drink water, to remove any food residues that are giving false positives.

    Am unsure but I thought that all the states are interfaced on the computer databanks now?

    Very nice post, AR.

    Sorry you wont be on here to see the compliment. Yes these things are difficult to say the least on many levels, and also, we all did put ourselves in this position. Although I disagree with the administration of this device, and all the things that go wrong that are not caused by the driver at all, I am committed so seeing through the rest of my term and jumping through all the hoops. The reduced sensitivity concerns me a lot b/c they werealready overly sensitive. I am not even drinking at all. But I will continue to do as they ask and keep plodding through til the finish.

    To the OP, I dont know specifics about your case. The last time I checked, if you get 2 dui’s within a 7 yr period in NC, you have the IID for 3 years.

    It used to be within a 10 year period but the rules are contracting as we speak, so I dont know what they currently are.

    Something needs to be done. Its truely insane. If the MADD executives (yes, its now run by $ executives, not mothers) had to use one I bet they would cease all this ignorant lobbying.

    Yesterday I left a job interview and once again my unit is coming up with hieroglyphic-looking gibberish on the screen. Then the screen went blank, and it verbally asked me for my passcode, but the screen remained blank so I could not enter it. It timed out, hieroglyphics again, again went blank and asked me for passcode. At this point I am on hold with Monitech’s 800 line. After not being able to enter passcode second time, it went into a 5 minute lockout. Four min of waiting on hold, Monitech dropped the call. At the end of the lockout, I reset myself by pulling off the handsat and replacing. For this, I got to have a loud alarm right outside where I had just had a job interview. It was either that, or have it towed into Monitech.

    It finally worked. But am sure the lockout is now on my “record,” even though its obvious the handset is messed up.
