    Must Originate and file my appeal to sham hearing in Gretna, LA!

    I got an automated speed ticket in Gretna,LA for 45 in a 35mph zone. I know I was not going 45 so I sent in the hearing section of the violation notice. The equipment, maintenance, calibration,ticket generation and collection are all managed by Redflex in Arizona. If you call the number on the violation with a Gretna letterhead, you will get Arizona Redflex customer service who are useless unless you want to pay the ticket. I have researched my situation and concluded that I had enough unanswered questions to plead not guilty and ask for a trial. At least I thought I could. Gretna is the only section of Jefferson Parish that is using the automated/mobile speed cameras. The rest of Jefferson parish has stopped for the time being because of corrupt politician kickback activity. I went to my hearing at the Clerk of Courts bldg. and arrived one hour early. I went into a small office where a police officer was sitting at one desk and an elderly man told me to have a seat at the other desk. He asked me if any other cars were around me at the time of the violation. I said “I don’t know”. He then explained that the camera car was calibrated every 2 hours and when the car is moved from one spot to another. I did not ask for calibration documents or contest what he was saying because I thought I would be able to ask my questions to an expert from Redflex at a trial. He showed me the same grainy video that I had already seen at Photonotice.com, complete with my face grayed out. He remarked that there were no cars around me and proceeded to fill out the guilty section of his paper with instructions to sent my payment of $150.00 within 30 days to Ohio. I asked him if he was an expert on Redflex equipment and he said,”No, I am a retired police officer”. I then tried to question his knowledge of the equipment and he said, “That’s it, it’s time for you to go”, and he escorted me to the door. I asked about my due process rights and that I have a right to appeal. He said I have to go to the 24th district civil appeals office to make an appeal. I was given no address or directions as his attitude made me leave because I feared I would be arrested if I asked another question. I then went down the street to the Gretna 2nd Parish Court where I was informed by security that I had to go to the Jefferson Parish Government Center a little bit further down the street. I went to the civil appeals office and they knew nothing. They had no paperwork for me to fill out and informed me that they had not had any appeals since Jefferson Parish cut off their cameras. Gretna seems to be exempt from Jefferson parish laws although they are part of the system. I was told they would except my appeal but I have to figure out what I need and pay to file it. They gave me a sheet with pro bono attorney offices for help. I called the nearest number and was told that they do not accept automated camera cases cause they are impossible to win. I was told that I had to go back to the clerk of courts office cause they handled Gretna traffic tickets. I was afraid to walk back into that building cause I knew that that front office where I had my “hearing” had a plate glass window and they could see me walking back into the building. I went anyway and this time I went into the other office where 3 windows collect fines, give information about court. I was told that they only know about tickets given by a real cop and know nothing about camera tickets. I felt defeated and left. I studied the code of Ordinances from Gretna and discovered that I have to contact the Municipal Court of Gretna (city hall). This morning I called that number and got a receptionist that became impatient with me because she could not answer my questions and she tried to give me the redflex number. She put a police officer on the phone after telling him I was irate and yelling at her-not true. He told me that he had gotten a ticket in the same spot and had to pay it. He was much more receptive and gave me a clerk of courts number and said to ask for the person that handles the Belle Chasse Hwy. camera tickets. I got this person on the phone and had a nice conversation. During this time I asked questions and learned that this person is the one that reviews the videos and her name is in the “officer” spot on the bottom of the ticket. She has no expertise in judging the speed, she just transfers the cameras speed reading to the paperwork needed so redflex can issue the citations. She checks to make sure the license plate is readable. She is an “officer” of the court-therefore no badge number. I later received a call from her boss, a lieutenant in the office, who was rude and impatient with me and said that everything I was saying about due process was wrong because it is a civil matter. I told her that the code of ordinances states that I have a right to a Judicial Review. She again said I was totally wrong and if I want to appeal I have to find the correct paperwork and file it with them within 21 days. I will get no help from them so I would have to find an attorney and do everything from my end. She then said,”Is there anything else I can help you with?”.
    As you can see this is another police dept. run revenue generator. They have figured out how to put all responsibility on the “guilty” person and leave you no recourse but to pay the dubious fine and get out of their way. Many people think that these tickets are from Gretna. I think that all Gretna really does is move the Ford Escape camera car around. I was also told that the camera flashes at 7 miles over the limit. I got a ticket for 10. Common sense reveals that these cameras are never 100% accurate. These cities think our constitutional rights are a joke and we have no right to question their authority.
    Yes, I am upset about this situation. I want anyone who drives through Gretna to be aware of the cameras. This “no due process” system is not constitutional and it will all be exposed eventually. Please drive the slow speed limits through Gretna and keep an eye out for a white Ford Escape with lights at the rear roof. This is the best thing to do to starve them of this revenue. Redflex will drop their contract if they don’t produce the agreed on quotas. Please tell everyone to pay attention because Gretna is not going to give you a break or a chance to defend yourself.

    I have been told that since the recession, all cities have clamped down on any infraction including speeding. I have been told this means even 3 mph over the speed limit. The cities need the money and truly, they do not give one whit about individual drivers, even if those drivers are facing the notion of living under a bridge. :S

    Good luck with your appeal, though. :)

    I have been told that since the recession, all cities have clamped down on any infraction including speeding. I have been told this means even 3 mph over the speed limit. The cities need the money and truly, they do not give one whit about individual drivers, even if those drivers are facing the notion of living under a bridge. :S

    PLEASE sign the petition and write to the Gretna council. Let them know you do not support their decision to reinstate the cameras.

    Gretna’s system is not like those in California or Arizona. The change from a criminal to a civil infraction nullifies their burden of proof responsibility, much like with a parking ticket. They do not care who was operating your car, only that you, as the owner, are responsible for allowing someone to operate it in such a manner. They have altered the system in such a way that anyone who gets a ticket is at an absolute disadvantage. Also, the ticket does not go away after 120 days, like in Arizona. Gretna charges unreasonably high late fees that will continue to accrue as long as the ticket is outstanding. A local Gretna lawyer has a site (http://gretnatraffictickets.com/photo-camera-safety-tickets/) and basically explains that in Gretna, they have worked out all of the loop-holes, except of course, if your car was actually reported stolen. It is futile to fight the ticket itself, but you can sign the petition and write to stop the usage of the cameras.

    Louisiana State Senator Danny Martiny has previously worked to address the reliance of cities and parishes on the revenue traffic cameras generate and State Representative Jeff Arnold has worked to require a public vote for the cameras to be used. Please write to them to tell them not to stop in their efforts or at the very least, ask them to use the funding for much needed roadway improvements instead of to fill the Gretna PD coffers.

    For a few months now, a speed camera has been parked in the 800 block of Huey P. Long Avenue just a block down from the mayor’s mansion. 8-)

    That camera got me a couple of months ago and issued my first ticket in 30-plus years doing one MPH over the regular limit, but I didn’t realize the school zone was in effect.
    OK, so I accept that and paid the ticket while being vigilant to watch for that camera since. I drive the route regularly every day to work.

    Today (12/30), I see that camera parked there and drove well under the speed limit (not a school day) and still saw the flash of the cameras.
    I can only hope they catch the mistake before sending me a ticket, but I’m not too optimistic.
