Mock Trial - Establishing the Situation

"Thank you, your Honor. Although I'm not a lawyer, as you can see from my clean record I have very little experience in the courtroom. Still, I'll try to show you this is a case of mistaken identity.
Officer William, as you testified, you were on a routine radar patrol. You were using a marked Brookline Police cruiser. Is that correct?"

"Yes, that's correct."

"And at approximately 3:15 that afternoon it was parked on the Eastbound side of Beacon Street, in the 1700 block. Is that correct?"

"Yes, that's correct."

"Besides the parking lane, how many travel lanes are there at this point of Beacon Street?"

"Well, there are two lanes in both directions."

"You mean there are two Eastbound and two Westbound travel lanes."

"Yes, that's correct."

"Could you please describe your method of checking traffic at that time?"

"I was using the standard operating procedure for verifying travel speed the Brookline Police Department has successfully deployed many times over the last ten year in many locations."

"Still, Officer, could you please briefly recap that method?"

"Well, after I calibrated the radar according to procedures, I carefully placed the radar on the roof of my low profile cruiser - "

"Excuse me Officer, by 'low profile' you mean a marked cruiser without the light bar?"

"Yes, that's correct."
